Certainly, Trisha. Probate is essentially a legal process that oversees the distribution of a deceased person’s assets according to their will or state intestacy laws if there isn’t a valid will. Ordinarily, it involves validating the will, identifying and inventorying assets, paying off debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries.

Tonight we’re going to focus on one specific step in the probate process: marshalling estate assets. Can you walk us through this crucial stage?
Marshalling estate assets is a foundational step in probate. It involves meticulously identifying and cataloging all of the deceased person’s assets, whether they be real estate, bank accounts, investments, vehicles, personal belongings, or even digital assets. Consequently, it’s important to leave no stone unturned. This inventory is then formally documented and submitted to the court in the form of an Inventory and Appraisal.
This stage can sometimes be complex, especially if the deceased individual had numerous assets spread across different institutions or jurisdictions. Moreover, locating all necessary documentation, such as deeds, titles, and account statements, can be time-consuming. Nevertheless, a thorough accounting of all assets is essential for ensuring that debts are paid promptly and that beneficiaries receive their rightful inheritance.
Speaking of which, I once had a case where the deceased individual had a significant collection of rare coins hidden away in a safe deposit box. The family was unaware of its existence until we uncovered it during the marshalling process.
