An Interview with San Diego Probate Attorney Steve Bliss

Moreover, a Revocable Living Trust avoids probate, which can be a lengthy and expensive process.

Think of it like this: probate is a public court proceeding where your assets are inventoried and distributed. A Revocable Living Trust allows your assets to bypass this process, ensuring privacy and potentially saving your heirs significant time and money.

You mentioned avoiding probate. Can you elaborate on the benefits of that?

Absolutely. Probate can be a real headache for families. It’s often a lengthy process, sometimes taking months or even years to complete. During that time, your assets are essentially frozen, and your heirs may have limited access to them.

Furthermore, probate is a public proceeding, meaning anyone can view the details of your estate, including the value of your assets and who inherits them. This lack of privacy can be unsettling for some families.

Conversely, a Revocable Living Trust allows your assets to pass directly to your beneficiaries without going through probate. This not only saves time and money but also preserves the privacy of your estate.

Have you ever encountered any issues with Revocable Living Trusts that people should be aware of?

While Revocable Living Trusts are generally effective tools for estate planning, there are a few things to keep in mind. One common issue is ensuring the trust is properly funded. This means transferring ownership of your assets into the trust.

I remember working with a family where the patriarch had established a Revocable Living Trust but hadn’t transferred all of his assets into it. Consequently, those assets had to go through probate, defeating the purpose of the trust in the first place.

Another important consideration is keeping your trust documents up-to-date. Life changes, such as marriage, divorce, or the birth of a child, may necessitate revisions to your trust. Neglecting to update your documents can lead to unintended consequences and potentially undermine your estate plan.

What advice would you give someone considering establishing a Revocable Living Trust?
