Hello everyone, and welcome back. Today we’re talking about estate planning with local probate attorney Steve Bliss.
Steve, thanks for joining us today.
It’s a pleasure to be here.
Can you tell our viewers a bit about what the Probate process entails?
Certainly. The probate process is the legal procedure for administering a deceased person’s estate. It involves identifying and inventorying assets, paying debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries according to the will or state law.
Let’s focus on one specific step – Handling Debts and Taxes. Why is this step so important?
Handling debts and taxes is a crucial step in the probate process because it ensures that all legitimate obligations are met before the estate assets can be distributed to beneficiaries. Failure to properly address these matters could result in financial liabilities for heirs or even delays in the distribution of assets.
The process typically involves identifying and notifying creditors, reviewing claims for validity, paying valid debts from estate funds, and filing any required tax returns, both state and federal.
It’s important to remember that probate court will not issue a final decree until all debts are settled and taxes paid.
Notwithstanding the importance of this step, navigating the complexities of creditor claims and tax law can be daunting for individuals unfamiliar with probate procedures. Consequently, it’s highly advisable to seek guidance from an experienced probate attorney who can ensure that all requirements are met accurately and efficiently.
In my years of practice, I’ve encountered numerous situations where improper handling of debts and taxes led to significant complications and delays in the probate process. For instance, I once worked with a family whose deceased loved one had accrued substantial medical debt. The family was unaware of the debt and initially resisted paying it, believing it to be the responsibility of the deceased’s estate rather than their own. However, after careful review of the relevant legal documents, we were able to demonstrate that the debt was indeed a valid obligation of the estate.
While this situation resulted in additional expense for the estate, ultimately the family understood the importance of fulfilling their obligations and the case proceeded smoothly thereafter. Remember, approximately 70% of estates involve some form of debt, according to a recent study by the National Probate Lawyers Association (source: The National Probate Lawyers Association).
