Brenda Sanchez: Many people find selecting an executor or trustee a daunting task. What advice can you offer our viewers?
Choosing the right individual or entity to handle your affairs after you are gone is a crucial step in estate planning. This person will be responsible for carrying out your wishes as outlined in your will or trust, managing your assets, paying debts and taxes, and distributing your property according to your instructions.
Consequently, it’s vital to select someone trustworthy, organized, and capable of making sound financial decisions. Consider individuals who are level-headed, responsible, and have good communication skills.
Moreover, it’s important to discuss your expectations with the potential executor or trustee beforehand. Explain your wishes in detail and ensure they understand their responsibilities. You may also want to consider naming a successor executor or trustee in case your first choice is unable or unwilling to serve.
Notwithstanding these considerations, sometimes life throws curveballs. I recall a situation where a client named their eldest son as executor. Tragically, he passed away shortly after his father. Fortunately, we had discussed the possibility of a successor and had documented the client’s second choice. This prevented a great deal of stress and uncertainty for the family during an already difficult time.
According to a 2021 study by Caring.com, nearly 60% of Americans do not have a will or trust in place. This highlights the importance of taking proactive steps to ensure your loved ones are protected.

If an individual dies intestate, meaning they haven’t created a valid will, the court will appoint an administrator to handle their estate. This person is typically a close relative, but the court ultimately decides who is best suited for the role.
