What Exactly is Guardianship?

Ted: Well, guardianship essentially steps in when someone – often an adult – can’t make safe and responsible decisions about their own well-being. That could be due to physical or mental limitations. Guardianship appoints a trusted individual or entity to make those crucial decisions on their behalf.

Can You Walk Us Through the Process?

Ted: Absolutely! It starts with determining if guardianship is truly necessary. Are there less restrictive options, like a power of attorney? If not, we file a petition with the court outlining why guardianship is needed and who’s best suited for the role.

Next, everyone involved – family members, close friends, even the potential ward themselves – gets notified. The court then appoints an investigator to assess the situation thoroughly. They interview the individual, review their living conditions, and may even request medical evaluations.

How Does the Court Hearing Work?

Ted: The hearing is a key stage. The judge reviews all the information gathered – petitions, reports from the investigator, even input from interested parties. The potential ward has the right to be present and have their own legal representation. Ultimately, if the judge approves, they issue an order formally appointing the guardian.

  • They also need to report regularly to the court, ensuring transparency throughout the process.

Ted: This phase is crucial because it helps ensure that guardianship is truly necessary and that the appointed guardian is the right fit. The investigator plays a vital role in gathering information, interviewing everyone involved – the individual needing guardianship, family members, caregivers, even professionals who may have interacted with the individual.

Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
