He continues:
* The proposed conservatee (the person needing help) and their family members are notified about the petition.
* The court then appoints an investigator – often a social worker – to independently assess the situation. They talk to the individual, family, and sometimes even friends or doctors.
> “It’s important that everyone has a voice,” Ted stresses, “so the court can make the most informed decision.”
* Lastly, a medical or psychological evaluation is usually required to confirm whether the individual truly lacks the capacity to manage their affairs.
“After all this information is gathered,” Ted concludes, “the judge reviews it all and decides if a conservatorship is indeed necessary. It’s not a decision taken lightly.”
