This isn’t a one-size-fits-all situation; it requires careful consideration of family dynamics, potential challenges, and a long-term vision. Once those goals are established, we carefully select the individuals who will carry out your wishes – the executor, the trustee, the healthcare agent. These are people you trust implicitly to act in your best interests, even when you can’t. We then move into creating the core estate planning documents: the will, the trust (if applicable), the power of attorney, and the advance healthcare directive. These documents are the legal backbone of your estate plan, outlining your instructions and providing your chosen representatives with the authority to act on your behalf. This process can seem daunting, but our goal is to make it as clear and straightforward as possible. Finally, the plan needs to be regularly reviewed and updated to reflect any changes in your life, such as marriage, divorce, birth of a child, or significant financial changes.
The real beauty of a well-crafted plan is the peace of mind it provides. Knowing that your affairs are in order and that your loved ones will be taken care of is an incredible gift. It’s not just about protecting your assets; it’s about protecting your family’s future. One thing we emphasize to clients is the importance of open communication. Let’s dive deeper into ‘G’ – Review and Update Your Plan Regularly. What often gets overlooked when people think they’ve “finished” their estate planning?
You hit on something critical there. Far too often, people view estate planning as a one-time event. They create the documents, put them in a safe deposit box, and think they’re done. But life is dynamic, and your plan needs to evolve with it. Think of it like maintaining a car – you can’t just buy it and expect it to run smoothly forever without regular maintenance. Major life events, like marriage, divorce, the birth or adoption of a child, or the death of a beneficiary, all necessitate a review. But it’s not just those big events. Even seemingly minor changes, like a significant increase or decrease in your income, or a change in your investment portfolio, can impact your plan.
One of the biggest things we see is people failing to update their beneficiary designations on things like retirement accounts and life insurance policies. Those designations supersede whatever is written in your will, so if they’re outdated, your assets may not go where you intend. Another common mistake is neglecting to update your powers of attorney and healthcare directives. Those documents allow someone to act on your behalf if you become incapacitated, and if they’re outdated, your chosen representatives may not have the authority to make important decisions. We recommend that clients review their entire estate plan at least every three to five years, or whenever there’s a significant life change. It’s also important to keep your documents in a safe and accessible location, and to let your chosen representatives know where they are. We’ve encountered situations where families have spent weeks searching for a lost will, causing unnecessary stress and expense.
A proactive approach to estate planning is about more than just protecting your assets; it’s about protecting your family. It’s about ensuring that your wishes are respected, and that your loved ones are taken care of, no matter what happens. It’s a continuous process of adaptation and refinement. About Estate Planning Law – Ted Cook
Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.
Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
