Today we’re going to talk about estate planning and the different types of trusts available. For those unfamiliar, can you explain what a trust is and why someone might want one?
Steve: A trust is essentially a legal entity that holds assets for the benefit of designated beneficiaries.
There are many reasons why someone might choose to create a trust as part of their estate plan. One common reason is to avoid probate, which can be a lengthy and expensive process. Trusts also offer privacy, as they are not subject to public scrutiny like wills. Moreover, trusts can provide for the management of assets for beneficiaries who may not be able to manage them themselves, such as minor children or individuals with special needs.
Steve: I often recommend Revocable Living Trusts to my clients because they offer a great deal of flexibility.
With a revocable living trust, you can maintain control over your assets during your lifetime and make changes to the trust as needed. The trust becomes irrevocable upon your death, at which point the assets are distributed to your beneficiaries according to your wishes.
Let’s delve into this type of trust further. What are some key advantages of a revocable living trust?
Steve: One of the biggest advantages is probate avoidance.
When you have a will, it must go through probate court after your death. This process can take months or even years and can be quite costly. With a revocable living trust, your assets bypass probate altogether.
Another advantage is privacy. Probate records are public, but the terms of a trust are confidential. Consequently, this allows you to keep your financial affairs private. Finally, revocable living trusts offer flexibility. You can change the terms of the trust at any time as long as you are alive and competent.
Steve: I’ve seen firsthand how probate can be a stressful and time-consuming process for families.
