Ordinarily, people start thinking about who they want to inherit their assets – spouses, children, grandchildren, or perhaps charitable organizations.
Moreover, it’s crucial to consider any specific needs your beneficiaries might have. Do you have a child with special needs who requires ongoing financial support? Are there educational expenses for grandchildren you wish to cover? Clearly defining these objectives will guide the rest of your estate planning decisions.
Conversely, neglecting this step can lead to unintended consequences. I once worked with a client who assumed his assets would automatically go to his children. However, he hadn’t specified how they should be divided. This resulted in conflict and resentment among his heirs, ultimately undermining his wishes for family harmony.
A recent study by the American Bar Association found that over 60% of Americans do not have a will or trust in place. Consequently, their assets are subject to state intestacy laws, which may not reflect their true intentions.
