Today I’m speaking with Steve Bliss, a renowned estate planning attorney here in Wildomar. Steve, thank you for taking the time to chat with me today about this important subject.
Steve Bliss
Brenda, it’s my pleasure. Estate planning is something everyone should consider, regardless of their age or financial status.
Determining Your Goals and Objectives: The Foundation of a Sound Estate Plan
Steve, could you elaborate on the importance of determining goals and objectives in estate planning?
Steve Bliss
Absolutely. This is often the very first step we take with clients. It’s about understanding what they truly value and want to achieve through their estate plan. Some common goals include providing for loved ones, ensuring a smooth transfer of assets, minimizing estate taxes, or supporting charitable causes. Clearly defining these objectives guides every other decision in the planning process.
Conversely, without clearly defined goals, an estate plan can become a confusing patchwork lacking direction. Consequently, it may not effectively serve the individual’s or family’s needs.
For instance, a young couple with children might prioritize ensuring their children are financially secure in case something happens to both parents. Their plan would likely focus on establishing guardianships and providing for their children’s education. On the other hand, an older individual without dependents might prioritize minimizing estate taxes or leaving a legacy through charitable donations.
Moreover, understanding your goals can help prevent future conflicts among beneficiaries. A well-defined plan leaves little room for ambiguity, making it less likely that family members will disagree on how assets should be distributed.
Notwithstanding the importance of this step, I’ve encountered situations where individuals haven’t taken the time to consider their goals. The result is often a plan that doesn’t truly reflect their wishes, leading to complications and dissatisfaction down the line.
I remember one case where a client had accumulated significant assets but hadn’t thought about how he wanted them distributed. After his passing, his family struggled with disagreements over who should inherit what. Had we taken the time to define his goals beforehand, this conflict could have been avoided.
Studies show that nearly 70% of Americans don’t have a will or estate plan (Caring.com, 2023). This highlights the critical need for individuals to prioritize this important step and ensure their wishes are honored.
