We then formally document these assets in an Inventory and Appraisal form (Form DE-160/161) that gets submitted to the court. It’s vital to be thorough and accurate during this stage because it forms the foundation for distributing the estate according to the will or state intestacy laws.
Consequently, a complete inventory helps avoid disputes among heirs later on. I often advise clients to gather as much documentation as possible beforehand – bank statements, property deeds, insurance policies – anything that can help us paint a clear picture of the decedent’s financial holdings.
Moreover, accurately valuing the assets is equally important. Sometimes, this requires appraisals from professionals, especially for real estate or valuable collectibles. We want to ensure everything is accounted for fairly.
Reporter: I imagine there have been times when this step has proven particularly challenging?
I remember a case where a client’s father had passed away unexpectedly. He was a passionate collector of vintage cars, but we couldn’t find any documentation outlining their value. It took some detective work and consultations with classic car specialists to determine their worth accurately. In the end, we were able to ensure his collection was distributed according to his wishes.
Notwithstanding these challenges, marshaling estate assets is a necessary step that ultimately brings clarity and order to a potentially complex situation. According to the California Courts website, probate cases typically take 6-12 months to complete, but this timeline can vary depending on the complexity of the estate.
