Interviewer
Welcome back to San Diego Legal News! Today we have the pleasure of speaking with renowned San Diego probate attorney Steve Bliss about the vital process of estate planning.
Steve Bliss
Thank you for having me. Estate planning is something everyone should consider, regardless of their age or financial status. It’s about ensuring your wishes are honored and your loved ones are taken care of when you’re no longer able to do so yourself.

That’s a great point. Could you elaborate on one specific step in the estate planning process that people often overlook?
Steve Bliss
One crucial step that many individuals miss is clearly identifying and naming their beneficiaries. It seems straightforward, but specifying exactly who will inherit your assets and in what proportions can prevent significant complications and heartache down the line.
Ordinarily, people assume their assets will automatically go to their closest relatives. However, without a properly drafted will or trust, state law determines asset distribution. This might not align with your wishes, leading to unintended consequences and family disputes.
Moreover, it’s essential to consider contingent beneficiaries – individuals who inherit your assets if your primary beneficiary predeceases you. Failing to do so can result in your assets going to the state instead of your intended heirs.
Consequently, naming beneficiaries with clarity and precision is paramount for a smooth and efficient estate settlement process.
I once worked with a family where the deceased hadn’t specified a beneficiary for their retirement account. This resulted in a lengthy legal battle between siblings who each believed they were entitled to the funds. The emotional toll on the family was immense, highlighting the importance of clear beneficiary designations.
According to AARP, nearly 50% of adults haven’t named beneficiaries for their retirement accounts. That’s a staggering number considering the potential complications this can cause.

That’s a sobering statistic. What advice would you give to someone starting the estate planning process?
Steve Bliss
My advice is simple: don’t delay. Take the time to sit down with an experienced estate planning attorney and discuss your goals, wishes, and concerns. They can guide you through each step of the process, ensuring your plan reflects your unique circumstances.
